BANGLADESH INTERNATIONAL CRIMES TRIBUNAL AND CASE OF ABDUL KADER MULLAH

That this House is very concerned about the failure of the Bangladesh International Crimes Tribunal (ICT), which despite its name is a domestic court, to uphold international fair trial standards; is particularly alarmed about the denial of due process rights in the case of Abdul Kader Mullah, a leader of the Jamaat-e-Islami party convicted of war crimes, who has recently been sentenced to death with no possibility of the sentence being reviewed, in contravention of Bangladesh's international human rights obligations; notes also the criticisms raised in connection with the trial of the Bangladesh National Party MP, Salahuddin Quader Chowdhury, who was recently convicted on charges including murder and genocide and sentenced to death, subject to an appeal; notes that, while holding perpetrators to account for the atrocities committed in the 1971 war of independence is important, the denial of due process in these trials threatens to undermine the very legitimacy of the ICT and result in further political instability and violence; and calls on the Government to raise these concerns as a matter of urgency with the government of Bangladesh and to urge it to end the possibility of the death penalty being handed down in these trials and allow legal experts from the international community to support the work of the ICT.

•  যুদ্ধাপরাধ ট্রাইব্যুনাল নিয়ে ব্রিটিশ সংসদে প্রস্তাব উত্থাপন
  
  বাংলাদেশে আন্তর্জাতিক অপরাধ ট্রাইব্যুনালের বিচার  কার্যক্রম নিয়ে গভীর উদ্বেগ প্রকাশ করে ব্রিটিশ সংসদে প্রস্তাব উত্থাপন করা হয়েছে।
  প্রস্তাবে বলা হয়েছে যুদ্ধাপরাধ বিচারের ক্ষেত্রে ট্রাইব্যুনাল  আন্তর্জাতিক মান রক্ষায় ব্যর্থ হয়েছে । বিচারের ক্ষেত্রে যথাযথ প্রক্রিয়া অনুসরন না করায় ট্রাইব্যুনালের বিচারের বৈধতা হুমকির মুখে পড়েছে এবং এতে করে বাংলাদেশে রাজনৈতিক অস্থিতিশীলতা ও সহিংসতা দেখা দিতে পারে।
  
  ব্রিটিশ পার্লামেন্টের ১৩ জন প্রভাবশালী সংসদ সদস্যের উত্থাপিত এ প্রস্তাবে অবিলম্বে যুক্তরাজ্য সরকারের প্রতি আহবান জানানো হয়েছে বাংলাদেশ সরকারের প্রতি এ বিষয়ে দৃষ্টি আকর্ষনের জন্য।
  
  প্রস্তাবে জামায়াতে ইসলামীর সেক্রেটারি জেনারেল আব্দুল কাদের মোল্লা এবং বিএনপি নেতা সালাহউদ্দিন কাদের চৌধুরীর মৃত্যুদন্ডের বিষয়ে উদ্বেগ প্রকাশ করা হয়েছে।
  
  গত ১৫ অক্টোবর ব্রিটিশ তথা যুক্তরাজ্যের সংসদে উত্থাপিত এ প্রস্তাবটি  (আর্লি ডে মোশন) সংসদের ওয়েবসাইটেও প্রকাশ করা হয়েছে।
  প্রস্তাবটি উত্থাপন করেছেন লেবার পার্টির সংসদ সদস্য কয়েড অ্যান। তাতে সমর্থন দিয়েছেন লেবার পার্টির  ডুরান মার্ক ও রিচি মার্গারেট, লিবারেল ডেমোক্র্যাট রাসেল বব, কনজারভেটিভ পার্টির বটমলি পিটার ডেমোক্র্যাটিক ইউনিয়ন পার্টির শ্যানন জিম।
  
  প্রস্তাবে বলা হয়েছে জামায়াত নেতা আব্দুল কাদের মোল্লাকে সম্প্রতি মৃত্যুদণ্ড দেয়া হয়েছে। এ দন্ডের বিরুদ্ধে  রিভিউ করার সম্ভাবনা নেই।  আন্তর্জাতিক মানবাধিকারের ক্ষেত্রে বাংলাদেশের যে বাধ্যবাধকতা রয়েছে এ ক্ষেত্রে তার  লক্সঙ্ঘন হচ্ছে। আব্দুল কাদের মোল্লার অধিকার রক্ষার ক্ষেত্রে যথাযথ প্রকৃয়া অনুসরন না করায় ব্রিটিশ সংসদ গভীরভাবে উদ্বিগ্ন।
  একই প্রস্তাবে বলা হয়েছে সম্প্রতি সালাহউদ্দিন কাদের চৌধুরীকে মৃত্যুদন্ড প্রদান করা হয়েছে ১৯৭১ সালে হত্যা এবং গণহত্যার অভিযোগে। ১৯৭১ সালের অপরাধের জন্য দায়ীদের বিচারের আওতায় আনা গুরুত্বপূর্ণ বিষয় কিন্তু বিচারের ক্ষেত্রে যথাযথ প্রক্রিয়া অনুসরন না করায় ট্রাইব্যুনালের বিচারের বৈধতা হুমকির মুখে পড়েছে এবং  এতে করে রাজনৈতিক সহিংসতা ও অস্থিতিশীলতা দেখা দিতে পারে। এ বিষয়গুলো বাংলাদেশ সরকারের কাছে তুলে ধরার জন্য ব্রিটিশ সরকারের প্রতি আহবান জানানো হয়েছে প্রস্তাবে।
  প্রস্তাবে মৃত্যুদন্ডের বিরোধিতা করে বলা হয়েছে বাংলাদেশে যুদ্ধাপরাধ ট্রাইব্যুনালের বিচার কার্যক্রমে আন্তর্জাতিক আইন  বিশেষজ্ঞরা যাতে সহায়তা করতে পারে সেক্ষেত্রে উদ্যোগ  গ্রহনের জন্য।
  
  প্রস্তাবের প্রতি অপর সমর্থনকারীরা হলেন, লেবার পার্টির ক্যম্পবেল রনি, ক্যাটন মার্টিন, করবিন জারেমি,  ডববিন জিম. এলিন পল ও  মিল এলান এবং  লিবারেল ডেমোক্র্যাটিক ওয়ার্ড ডেভিড।
